For legal advice regarding patents, you would want to contact a specialized patent attorney who is familiar with all applicable laws in your jurisdiction. I am aware about the restrictions of the patent for software. But, my concern is regarding the Licence conflict with Nvidia (Distributable CUDA Toolkit) if I am intending to patent my program using them.
