Hello NVIDIA team,
I hope you’re well. I’d love to get clarification on two points regarding the use of your trial API services:
Are prompts and generated outputs from the API is logged or retained for model training or other internal purposes beyond providing the service during a session?
Do users retain full ownership of the outputs generated using your API, especially when using models governed by permissive licenses (e.g., MIT)?
Thank you for your time, and I appreciate any insight you can provide.
Best regards,
Madison.
Hi @Madison89,
We keep our information about User generated content in our API terms of service. Please take a look and reach out if you have further questions. https://assets.ngc.nvidia.com/products/api-catalog/legal/NVIDIA%20API%20Trial%20Terms%20of%20Service.pdf.
Best,
Sophie
Hello, and thank you for your previous response.
After reviewing the Terms of Service in more detail, I have a few follow-up questions I hope you can help clarify:
While the agreement notes that operational data such as session metrics and error logs are collected (Section 3.3), can you confirm whether User Content and Generated Content themselves are ever logged, stored, or reviewed, outside of explicitly disclosed services like fine-tuning? I’d like to verify that prompt and output content are excluded from persistent storage or internal model training unless explicitly stated.
In Section 2.2, it states that NVIDIA may use, store, and modify User Content and Generated Content during the session solely to provide the API Service. However, Section 2.3 then says that NVIDIA will not store or use User or Generated Content at the end of each API session, except in specific cases. This appears to suggest that content is not retained long-term, but 2.2 still grants NVIDIA fairly broad operational rights during the session. Could you please clarify:
Whether any of those rights (e.g., modifying or creating derivative works) persist after the session ends?
Whether any session data could be cached, logged, or reused internally beyond immediate response delivery?
Regarding the NVIDIA Community License, does it apply only to models and derivatives distributed by NVIDIA, or does it also govern outputs or derivative works created by end users (like myself) when using the model through the API?
Thank you again for your time and continued assistance. I appreciate the clarification.
Best regards, Madison.
As far as I can tell, Section 2.2 grants the right to process data in general, but Section 2.3 states that no user content is stored. Right?
However, as this is a very important and sensitive topic, I would also like to ask again what happens to user data and content after a session/API request ends?
Thanks, Martin
I would like to add another point from the TOS.
2.7 states that:
“NVIDIA may, but is not obligated to, block, monitor, scan or review communications or User Content or Generated Content transmitted through the API Service…”
Which hints at potential monitoring or temporary access. I would love to know what happens user data and the generated content from using the API after a session ends aswell.
Thanks, Santrini.
NVIDIA posts its terms regarding use of User Content and Generated Content and data collection practices in the NVIDIA API Trial Terms of Service (Sections 2 and 3).
NVIDIA’s current terms specify that unless disclosed for a specific API Service, NVIDIA will use User Content and Generated Content solely to provide users with the API Service (Section 2.2 and 2.3). NVIDIA’s notice of any data collected during your use of the service is disclosed in Section 3.3 of the NVIDIA API Trial Terms of Service.
Please review the NVIDIA API Trial Terms of Service before your session on the API Catalog. If you do not accept the terms and conditions, do not use the API Service.
Best,
Sophie
Hello,
Thank you for the clarification regarding User Content and data handling, I appreciate you addressing it. I’ve reviewed the Terms of Service (Sections 2 and 3) and will keep these guidelines in mind while using the API Catalog.
Best regards,
Madison.
