Flashing encrypted dtb does not work defaults to nvidia /dvs/git/dirty

I am trying to fix the issue with ath9k/10k on jetson nano (AIRETOS AEX-QCA9880-NX wifi module on jetson nano) and when flashing new dtb at first boot the new dts is in kernel logs but after a reboot system is defaulting to dvs/git. Such a strange issue, never seen this on any tegra platforms but this is the first qspi-sd flashing any of us have dealt with. Please help with flashing new DTB and having it permanent. Thanks in advance community and NVIDIA devs.

I have flashed with both creating sdcard blob.img and also flashing signed encrypted dtb:

sudo ./flash.sh -r -k DTB jetson-nano-qspi-sd mmcblk0p1
also tried flashing DTB to RP1 which is bootloader DTB i believe.

logs:

This is a known issue and should be fixed. I think you need this patch.
