Capture software using NvFBC prohibited for independant developers?

Hi, this NVFBC recording path is still actively updated on Nvidia App(By Nvidia) in 2026 on my RTX 5090, but no official and safe tools anymore from Nvidia for independant developers to build their own recording software using NvFBC ? Just why ? Do I need special authorizations from Nvidia ?
